1. About This Policy
This Privacy Policy explains how Upzone Pty Ltd (“we”, “us”, or “Upzone”) collects, uses, discloses, and protects your personal information when you use our platform at upzone.au and related services.
We are committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy describes how we handle your personal information as required under APP 1.
2. Information We Collect
In accordance with APP 3, we only collect personal information that is reasonably necessary for our functions and activities. We collect the following categories of information:
Account information
When you create an Account, we collect your name, email address, and password. If you sign up through a third-party authentication provider, we receive your name and email address from that provider.
Usage data
We collect information about how you use the Platform, including properties searched, features accessed, pages visited, and actions taken within the application.
Technical data
We automatically collect technical information including your IP address, browser type and version, operating system, device type, and referring URL.
Billing information
If you subscribe to a paid plan, payment processing is handled by our third-party payment processor. We do not store your full credit card number. We retain billing records including transaction dates, amounts, and subscription tier.
Saved content
We store content you choose to save on the Platform, including saved searches, property notes, and custom analyses.
Communications
If you contact us by email or through the Platform, we retain the content of those communications.
3. How We Collect Information
In accordance with APP 3 and APP 5, we collect personal information:
- Directly from you — when you register an Account, update your profile, save searches, contact us, or otherwise interact with the Platform.
- Automatically — through cookies, analytics tools, and server logs when you access and use the Platform.
- From third-party authentication providers — when you choose to sign up or log in using a third-party service (such as Google), we receive your name and email address from that provider.
Where practicable, we collect personal information directly from you. We will notify you at or before the time of collection, or as soon as practicable afterwards.
4. Why We Use Your Information
In accordance with APP 6, we use your personal information only for the purposes for which it was collected, or for related purposes you would reasonably expect. Specifically, we use your information to:
- provide, maintain, and improve the Platform and Services;
- process subscription payments and manage your Account;
- personalise your experience, including remembering your preferences and saved searches;
- communicate with you about your Account, subscription, and service updates;
- analyse usage patterns to improve the Platform’s functionality and performance;
- comply with our legal obligations, including tax and record-keeping requirements; and
- detect, prevent, and address fraud, security issues, and technical problems.
We will not use your personal information for direct marketing without your consent.
5. Data Hosting and Storage
In accordance with APP 8 and APP 11, we take reasonable steps to protect your personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure.
- All data is hosted on servers located in Australia.
- Data is encrypted in transit using TLS 1.2 or higher.
- Data is encrypted at rest using industry-standard encryption.
- Access to personal information is restricted to authorised personnel who require it to perform their duties.
6. Disclosure of Personal Information
In accordance with APP 6 and APP 8, we may disclose your personal information to:
- Service providers — third parties who assist us in operating the Platform, processing payments, hosting data, and providing customer support. These providers are contractually required to protect your information and use it only for the purposes we specify.
- Legal requirements — when required by law, regulation, or legal process, or to protect the rights, property, or safety of Upzone, our users, or the public.
- Business transfers — in connection with a merger, acquisition, or sale of all or substantially all of our assets, in which case we will notify you before your personal information is transferred.
We do not sell your personal information to third parties. We do not share your personal information with third parties for their own marketing purposes.
We do not transfer personal information outside Australia. If this changes in the future, we will update this policy and ensure any overseas recipients comply with the APPs in accordance with APP 8.
7. Third-Party Services
We use the following categories of third-party services in the operation of the Platform:
- Payment processing — to securely process subscription payments.
- Authentication providers — to enable third-party sign-in options.
- Analytics — to understand how the Platform is used and identify areas for improvement.
- Hosting and infrastructure — to operate and deliver the Platform.
We select service providers that maintain appropriate privacy and security standards, with preference for Australian-based providers where feasible.
9. Your Rights
Under the Australian Privacy Principles (APP 12 and APP 13), you have the right to:
- Access — request a copy of the personal information we hold about you.
- Correction — request that we correct any inaccurate, out-of-date, incomplete, irrelevant, or misleading personal information.
- Deletion — request that we delete your personal information, subject to any legal obligations that require us to retain certain records.
- Complaint — if you believe we have breached the APPs, you may lodge a complaint with us. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.
To exercise any of these rights, contact us at support@upzone.au. We will respond to your request within 30 days. We will not charge you for making a request unless the request is manifestly unfounded or excessive.
10. Data Retention
We retain your personal information for as long as your Account is active or as needed to provide you with the Services. If you delete your Account:
- Your account data and saved content will be deleted within 30 days.
- Billing records will be retained for 7 years in accordance with Australian tax law (Taxation Administration Act 1953).
- Aggregated, de-identified usage data may be retained indefinitely for analytics purposes.
11. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable laws. We will provide at least 30 days’ notice of material changes by email to the address associated with your Account and by posting a notice on the Platform. Your continued use of the Platform after the effective date of the revised policy constitutes your acceptance of the changes.
